Introduction Death is an inevitable part of clinical practice and affects, in its very own way, not only next of kin and friends but also the members of the clinical team, in particular physicians and nurses, as those who take care of a patient in the very last moments of his or her life. Nevertheless, in clinical everyday life, it is no matter of course to meet the end of human life not only on a physical but also metaphysical level. (...) Definition of the problem In Western sociocultural contexts, silence is commonly regarded as an adequate expression of respect in the context of death. Considering that time is a more than limited resource in Western healthcare systems, it can, however, be challenging for the clinical team to pause and pay respect to the life that has passed and to generally deal with the unfathomability of human finiteness. Instead, death tends to become drowned out by a strident clinging to the common routines of patient care, in the course of which everyday clinical noises can turn into a roaring, almost inhuman cacophony—a cacophony that may not do justice to the dignity of the deceased, the relatives, or the clinic team. Objective With that said, this article focuses on forms of bidding farewell in clinical patient care, with an emphasis on post-mortem silence. Drawing on examples from literature, medical ethics, and the law, I will plead for a moment of silence in everyday clinical practice as a possible means to interrupt the noise of medicine in the immediate aftermath of death to honor the dignity of both the dead and the living. Paul Cilliers has developed a novel post-structural approach to complexity that has influenced several writers contributing to the current complexity literature. Concomitantly however, Cilliers advocates for modelling complex systems using connectionist neural networks (rather than analytic, rule-based models). In this paper, I argue that it is dilemmic to simultaneously hold these two positions. Cilliers’ post-structural interpretation of complexity states that models of complex systems are always contextual and provisional; there is no exclusive model of complex systems. This sentiment (...) however appears at odds with Cilliers’ promotion of connectionist neural networks as the best way to model complex systems. The lesson is that those who currently follow Cilliers’ post-structural approach to complexity cannot also develop a preferred model of complex systems, and those who currently advocate for some preferred model of complex systems cannot adopt the post-structural approach to complexity without giving up the purported objectivity and/or superiority of their preferred model. Prima facie, we make successful decisions as we act on and intervene in the world day-to-day. Epistemologists are often concerned with whether rationality is involved in such decision-making practices, and, if so, to what degree. Some, particularly in the post-structuralist tradition, argue that successful decision-making occurs via an existential leap into the unknown rather than via any determinant or criterion such as rationality. I call this view radical voluntarism (RV). Proponents of RV include those who subscribe to a view (...) they call Critical Complexity (CC). In this paper, I argue that CC presents a false dichotomy when it conceives of rationality in Cartesian – i.e. ideal and transcendental – terms, and then concludes that RV is the proper alternative. I then outline a pragmatist rationality informed by recent work in psychology on bounded rationality, ecological rationality, and specifically embodied rationality. Such a pragmatist rationality seems to be compatible with the tenets of post-structuralism, and can therefore replace RV in CC. (shrink)

About a decade ago, the Netherlands Environmental Assessment Agency unwittingly embarked on a transition from a technocratic model of science advising to the paradigm of ‘‘post-normal science’’. In response to a scandal around uncertainty management in 1999, a Guidance for ‘‘Uncertainty Assessment and Communication’’ was developed with advice from the initiators of the PNS concept and was introduced in 2003. This was followed in 2007 by a ‘‘Stakeholder Participation’’ Guidance. In this article, the authors provide a combined insider/outsider perspective (...) on the transition process. The authors assess the extent to which the PNS paradigm has delivered new approaches in the agency’s practice and analyze two projects—on long-term options for Dutch sustainable development policy and for urban development policy—the latter in somewhat more detail. The authors identify several paradoxes PBL encounters when putting the PNS concept into practice. It is concluded that an openness to other styles of work than the technocratic model has become visible, but that the introduction of the PNS paradigm is still in its early stage. (shrink)

South Africa's transition to democracy coincided and interlinked with massive global shifts, including the fall of communism and the rise of western capitalist triumphalism. Late capitalism operates through paradoxical global-local dynamics, both universalising identities and expanding local particularities. The erstwhile hegemonic identity of apartheid, 'the Afrikaner', was a product of Afrikaner nationalism. Like other identities, it was spatially organised, with Afrikaner nationalism projecting its imagined community onto a national territory. The study traces the neo-nationalist spatial permutations of 'the Afrikaner', following (...) Massey's understanding of space as political, produced through interrelations ranging from the global to micro intimacies, potentially a sphere for heterogeneous co-existence, and continuously created. Research is presented that shows a neo-nationalist revival of ethnic privileges in a defensive version of Hall's 'return to the local'. Although Afrikaner nationalism's territorial claims to a nation state were defeated, neo-nationalist remnants reclaim a purchase on white Afrikaans identities, albeit in shrunken territories. This phenomenon is, here, called Afrikaner enclave nationalism. Drawing on a global revamping of race as a category of social subjugation, a strategy is deployed that is here called 'inward migration'. These dynamics produce a privatised micro-apartheid in sites ranging from homes, to commercial and religious enterprises, to suburbs. Virtual white spaces in the form of Afrikaans media products serve as extensions of these whitened locales. The lynchpin holding it all together is the heteronormative, middle-class family, with consumption the primary mode of the generation of its white comfort zones. (shrink)

Crossing the road within the traffic system is an example of an action human agents perform successfully day-to-day in complex systems. How do they perform such successful actions given that the behaviour of complex systems is often difficult to predict? The contemporary literature contains two contrasting approaches to the epistemology of complex systems: an analytic and a post-modern approach. We argue that neither approach adequately accounts for how successful action is possible in complex systems. Agents regularly perform successful actions (...) without obeying (explicit or implicit) algorithmic rules (as the analytic approach suggests) and without an existential leap to action (as the post-modern approach suggests). We offer an alternative: A common-sense pragmatist epistemology, one that focuses on the kind of actions making up most agents’ successful moment-to-moment actions in complex systems. Successful actions obtain when agents apply ceteris paribus rules-of-thumb during predictive and decisional practices while achieving some desired goal. (shrink)

Especially in the case of proposed wind farms (an environmentally benign technology in terms of low carbon emissions), (...) opponents frequently refer to the unsightly machines creating negative landscape impacts and ruining the view. This essay seeks to reflect on the particular ways in which visual aesthetics are framed and mobilized in this moral debate. Exploring the dividing lines between pictoral and more-­ than-­ representational approaches I ask if the moral dilemmas in our landscape decisions (e.g. individual rights to beauty or collective duties toward future generations) are obscured by physical or visual realms. The largely invisible nature of wind, electricity and climate change, set within the physical and tangible nature of landscapes and turbines, challenges us to experience the aesthetics of landscapes-­ with-­ machines through more creative and engaging means that are not limited to visibility, nor deaf to morality. SIN, DUTY, AND THE AESTHETICS OF NATURE As the first act of sin in the bible, Eve’s consumption of a visually aesthetic fruit led to humans being banned from the Garden of Eden. Looking at the above sentence more closely, we could even argue that “good for food” is not a positive condition (e.g. tasty, nourishing), but Justice in the Eye of the Beholder? ‘Looking’ Beyond the Visual Aesthetics of Wind Machines in a Post-­Productivist Landscape DAN VAN DER HORST Dan van der Horst / Justice in the Eye of the Beholder? 135 rather the absence of a negative (e.g. inedible), whilst “also desirable” may sound like the hunger for wisdom was only a secondary, additional attraction. The sentence thus draws attention to the key role of aesthetics in the making of a moral decision; would Eve have eaten the forbidden fruit if it was not “pleasing for the eye”? Aesthetic judgments may be informed by a range of factors, but as this bible quote illustrates, morality is key among them. Associations between right and wrong on the one side and beauty or ugliness on the other, are not exactly rare in written history, be they religious, literary or scholastic works. As a marked contribution to the latter, Immanuel Kant has paid particularly close attention to the links between aesthetics and morality, arguing amongst others that any universal agreement in judgments of the sublime must rest on an appeal to moral feelings.1 But universality is not the only logical link between aesthetic judgementandmorality.Peoplecanfeelasenseof‘duty’tofindcertainthings beautiful e.g. because that is the aesthetic judgment of the group they aspire to belong to.2 Whilst this sense of duty can refer to social conditioning and group belonging, it also has resonance for landscape aesthetics at a time of anthropogenic climate change (a universal threat) when we must “learn to love the low carbon landscape.”3 This presents a point of departure from the debate on the moral obligation of preserving aesthetically pleasing landscapes (as we tend to do through legal designations, e.g. national parks), an ethical logic which leads, to use the words of Holmes Rolston, “from beauty to duty.”4 Moreover a posi­ tive aesthetical appreciation of a landscape because it accommodates low carbon technologies, would potentially require an inverse ethical logic, i.e. from duty to beauty.5 Notwithstanding the clear conceptual links between moral and aesthetic judgment, in everyday life it may be far less clear what kind of moral issues may underpin particular expressions of aesthetic sensibility. This can be particularly problematic for the deployment of environmental technologies (i.e. technologies pursued to reduce pollution ) that have significant landscape footprints. That is where we can find universal moral claims demanding environmental action for the common good rubbing up against aesthetic landscape judgments in places where such developments are proposed. In the academic debate on infrastructures in the Global South, there is a broad consensus that (post)colonial legacies present a major challenge for a transition towards more inclusive, sustainable and adapted modes of providing services. Yet, relatively little is known about the emergence and evolution of infrastructures in former colonies. Until a decade ago, most historical studies followed Daniel Headrick’s (1981) “tools of empire” thesis, painting—with broad brush strokes—a picture of infrastructures as instruments for advancing the colonial project of (...) exploitation and subordination of non-European peoples and environments. This paper explores new research perspectives beyond this straightforward, ‘diffusionist’ perspective on technology transfer. In order to do so, it presents and discusses more recent studies which focus on interactive transfer processes as well as mechanisms of appropriation, and which increasingly combine approaches from imperial history, environmental history, and history of technology.There is much to gain from unpacking the changing motives and ideologies behind technology transfer; tracing the often contested and negotiated flows of ideas, technologies and knowledge within multilayered global networks; investigating the manifold ways in which infrastructures reflected and (re)produced colonial spaces and identities; critically reflecting on the utility of large (socio)technical systems (LTS) for the Global South; and approaching infrastructures in the (post)colonial world through entangled histories of technology and the environment. Following David Arnold’s (2005) plea for a “more interactive, culturally-nuanced, multi-sited debate” on technology in the non-Western world, the paper offers fresh insights for a broader debate about how infrastructures work within specific parameters of time, place and culture. Umuntu ngumuntu ngabantu is the Zulu version of a traditional African aphorism . Although with considerable loss of culture-specific meaning, it can be translated as: “A human being is a human being through other human beings.” Still, its meaning can be interpreted in various ways of which I would like to highlight only two, in accordance with the grammar of the central concept ‘Ubuntu’ which denotes both a state of being and one of becoming.Firstly, it can be interpreted as a (...) statement of fact about the human condition, i.e. as a descriptive claim about the social nature of human being and personal identity; even the constitutive relation between alterity and identity. Secondly, it can also be interpreted as a value-judgement, i.e. as a normative appreciation of social difference and human diversity; even as an imperative to expose ourselves to others, to encounter the difference of their humanness, in order to fully become our own. The meaning would then be — to paraphrase a translation of Ramose : To be human is to affirm one’s humanity by recognising the humanity of others in its infinite variety of content and form.CONCLUSION :The challenge of a philosophical understanding of the multi-cultural context of apartheid South Africa has still to be met. To meet this challenge is to try and trace the consequences of what it would mean if — to paraphrase Walzer — our crucial commonality is our particularity. Perhaps it will mean accepting that what we are and are becoming, our identity, escapes any reduction to the categories of the ‘self’ and the ‘other’ and eludes a dialectical ‘aufhebung’ of their difference. This may be the case if what we are and are becoming involves the paradox of being and becoming ever more different in the realisation of our self-sameness. Our African aphorism speaks of this paradox and, in so doing, it draws a limit to our philosophical understanding and provides us with a rule of conduct: Umuntu ngumuntu ngabantu! (shrink)

Heidegger has often been considered as the proponent of the end of metaphysics in the post-Hegelian philosophy, due to his persistent attempts to overcome the onto-theological framework of traditional metaphysics. Yet, this dismissal of metaphysical, theological, and religious motives is deeply ambiguous since new forms of metaphysical and religious experience re-emerge in his philosophical works. Heidegger shares this ambiguous relation to the notions of faith and religion with authors such as Nietzsche and Wittgenstein whose works are also marked by (...) a critique of metaphysics and by a characteristic rethinking of the role of faith and religion. In fact, all three still remain, among other things, reference points for contemporary philosophical debates relating to the phenomenon of religion and faith. Rethinking Faith explores how the phenomena of religion and faith are present in the works of Heidegger, Nietzsche, and Wittgenstein, and how these phenomena are brought into play in their discussion of the classical metaphysical motives they criticize. This article challenges the general thesis that an unconditional basic income, set at the highest sustainable level, is required for maximizing the income-leisure opportunities of the least advantaged, when income varies according to the responsible factor of labor input. In a linear optimal taxation model (of a type suggested by Vandenbroucke 2001) in which opportunities depend only on individual productivity, adding the instrument of a uniform wage subsidy generates an array of undominated policies besides the basic income maximizing policy, including (...) a “zero basic income” policy which equalizes the post-tax wage rate. The choice among such undominated policies may be guided by distinct normative criteria which supplement the maximin objective in various ways. It is shown that most of these criteria will be compatible with, or actually select, the zero basic income policy and reject the basic income maximizing one. In view of the model's limited realism, the force of this main conclusion is discussed both in relation to Van Parijs' argument for basic income in Real Freedom for All (1995) and to some key empirical conditions in the real world. In studying the history of the ethics of war, the just war tradition may be interpreted as a historically evolving body of tenets about just war principles. Instead of a single just war theory, there have been many just war theories—for example, those of Augustine, Aquinas, Vitoria, and Grotius—theories that have various commonalities and differences. A comprehensive history of the evolving just war tradition should feature a thorough study of how these just war theories were rethought. For example, in his (...) landmark work Just and Unjust Wars, written during the Cold War, Michael Walzer exclaimed: “Nuclear weapons explode the theory of just war.” 1 In his rethinking of the just war tradition in light of the superpower practice of nuclear deterrence, he contributed his influential conception of supreme emergency exceptions. Now that the Cold War is over, the authors of the articles in this book are primarily concerned with the question of how the just war tradition—which is understood somewhat differently by the different authors—should be rethought today. Echoing Walzer’s exclamation, among the particular post–Cold War questions that can be raised are these: Is just war theory exploded by terrorism? Is it annihilated by genocide? In their various rethinkings of the just war tradition, our authors state their own particular post–Cold War questions, and answer them from their diverse viewpoints... (shrink)

This presentation discusses why just war theory is in need of just military preparedness (jus ante bellum) as a new category of just war thinking and it articulates six principles of just military preparedness. The paper concludes that the United States fails to satisfy any of these principles and addresses how this bears on the application of jus ad bellum, jus in bello, and jus post bellum norms to possible future American military interventions.

The underlying mechanisms of the effectiveness of mindfulness-based interventions for emotional well-being remain poorly understood. Here, we examined the potential mediating effects of cognitive reactivity and self-compassion on symptoms of depression, anxiety and stress using data from an earlier randomised controlled school trial. A moderated time-lagged mediation model based on multilevel modelling was used to analyse the data. The findings showed that post-treatment changes in cognitive reactivity and self-coldness, an aspect of self-compassion, mediated subsequent changes in symptoms of depression, (...) anxiety and stress. These results suggest that cognitive reactivity and self-coldness may be considered as transdiagnostic mechanisms of change of a mindfulness-based intervention programme for youth. (shrink)

If the theme of this special edition can be reformulated as a question (what was and is the current use of the Bible in theology?), it would be challenging and very difficult to answer the question because of a diverse usage of the Bible throughout history and today, stretching in a continuum of both vertical and horizontal probabilities: vertically, theism vs. atheism and horizontally, worldliness vs. holiness. The objective of this essay is to argue for the incorporation of the ‘spiritualities’ (...) of divine immanence and divine transcendence in the composition of theologies, facilitated by a comprehensive and multidimensional reading of the Bible and the acknowledgement of contributions from the sciences. In this research, the reasoning will address the following relevant aspects: (1) taking into account the epistemology of the ‘Bible’ and ‘Theology’; (2) the consideration of postmodernity, post-secularism and spirituality and (3) the composition of neo-theologies. Contribution: This article pleads that biblical analyses should play a more comprehensive and determinative role in the composition and formulation of theology, pointing more explicitly to the transcendence and immanence of God. The reading of such theologies then must create different lived experiences of the immanence and transcendence of God. (shrink)

ABSTRACT This paper argues for the contemporary relevance of melancholy as something different than depression or a state of mental illness. Instead, through examples of a literary, philosophical, and artistic nature, it is shown that melancholy functions as a force-field – a topos where the finite and the infinite, the earthly and the heavenly, the physical and the spiritual come together and meet in huge tension. By means of an exploration of the historical notion of melancholy and a revisit of (...) Dürer’s Melencolia I (1514), coupled to a much more recent example, Lars von Trier’s film melancholia (DK/se/fr/de 2011), this paper shows how the melancholic motif continues to play an essential role in our contemporary society. The melancholic is described as a person who lives a life on the border: who intuits the point where two worlds meet and who longs for a revelation of the beyond – an apocalypse (literally: ‘an uncovering’). It is this longing – a nostalgia for being – that increasingly pervades our contemporary world, a world that represses the heterogeneous through numerous social and political conditions. The study of melancholy here undertaken therefore provides a valuable contribution to the understanding of melancholy in our (post-) modern time. (shrink)

In his 1985 book on philosophy and atheism, the Canadian thinker Kai Nielsen, a prolific writer on the subject, wonders why the philosophy of religion is ‘so boring’, and concludes that it must be ‘because the case for atheism is so strong that it is difficult to work up much enthusiasm for the topic.’ Indeed, Nielsen even regards most of the contemporary arguments for atheism as little more than ‘mopping up operations after the Enlightenment’ which, on the whole, add little (...) to the socio-anthropological and socio-psychological accounts of religion provided by thinkers like Feuerbach, Marx and Freud, as any ‘reasonable person informed by modernity’ will readily acknowledge. On this view, the answer to Kant's question – ‘What may we hope?’ – does not gesture towards a resurrection and personal immortality, but instead to the death of religious discourse itself: I think, and indeed hope, that God-talk, and religious discourse more generally, is, or at least should be, dying out in the West, or more generally in a world that has felt the force of a Weberian disenchantment of the world. This sense that religious convictions are no longer a live option is something which people who think of themselves as either modernists or post-modernists very often tend to have. (shrink)

The social implications are enormous, yet this crisis has remained largely uncharted-until now. In Science on the Verge, luminaries in the field of post-normal science and scientific governance focus attention on worrying fault-lines in the use of science for policymaking, and the dramatic crisis within science itself. How important is the ability to freely control eye movements for reading comprehension? And how does the parser make use of this freedom? We investigated these questions using coregistration of eye movements and event‐related brain potentials (ERPs) while participants read either freely or in a computer‐controlled word‐by‐word format (also known as RSVP). Word‐by‐word presentation and natural reading both elicited qualitatively similar ERP effects in response to syntactic and semantic violations (N400 and P600 effects). Comprehension was better in free reading but (...) only in trials in which the eyes regressed to previous material upon encountering the anomaly. A more fine‐grained ERP analysis revealed that these regressions were strongly associated with the well‐known P600 effect. In trials without regressions, we instead found sustained centro‐parietal negativities starting at around 320 ms post‐onset; however, these negativities were only found when the violation occurred in sentence‐final position. Taken together, these results suggest that the sentence processing system engages in strategic choices: In response to words that don't match built‐up expectations, it can either explore alternative interpretations (reflected by regressions, P600 effects, and good comprehension) or pursue a “good‐enough” processing strategy that tolerates a deficient interpretation (reflected by progressive saccades, sustained negativities, and relatively poor comprehension). This article discusses the way in which a group of contemporary cultural theorists in whose work we see a “new materialism” (a term coined by Braidotti and DeLanda) at work constitutes a philosophy of difference by traversing the dualisms that form the backbone of modernist thought. Continuing the ideas of Lyotard and Deleuze they have set themselves to a rewriting of all possible forms of emancipation that are to be found. This rewriting exercise involves a movement in thought that, in (...) the words of Bergson, can be termed “pushing dualism to an extreme.” By this movement, Deleuze has stated, “difference is pushed to the limit,” that is, using Colebrook’s words, “difference is shown differing.” The article addresses the ways in which modernity’s dualisms (structured by a negative relation between terms) are traversed, and how a new conceptualization, and ontology, of difference (structured by an affirmative relation) comes to be constituted along the way. New materialism leaves behind all prioritizations (implicitly) involved in modern dualist thinking since a difference structured by affirmation does not work with predetermined relations (e.g., between mind and body) nor does it involve a (counter-)hierarchy between terms. The article makes explicit the methodology of the current-day rise of non-dualist thought, both in terms of its non-classificatory mode of (Deleuzian) thinking and in terms of the theory of the time of thought thus effectuated (Lyotard’s notion of ‘rewriting modernity’ is not a post-modernism). Throughout the article we will engage with an example in order to demonstrate the ontology that is being practiced following this methodology: How does a new (feminist) materialism traverse the sexual dualisms that structure modernist (feminist) thinking? This example also shows how a feminist post-modernism (found in the canonical work of Butler) has remained dualist, and what makes new materialism “new.” Freed from a dualist methodology, the modernist emancipatory project comes to full fruition in new materialism. In the academic debate on infrastructures in the Global South, there is a broad consensus that (post)colonial legacies present a major challenge for a transition towards more inclusive, sustainable and adapted modes of providing services. Yet, relatively little is known about the emergence and evolution of infrastructures in former colonies. Until a decade ago, most historical studies followed Daniel Headrick’s (1981) “tools of empire” thesis, painting—with broad brush strokes—a picture of infrastructures as instruments for advancing the colonial project of (...) exploitation and subordination of non-European peoples and environments. This paper explores new research perspectives beyond this straightforward, ‘diffusionist’ perspective on technology transfer. In order to do so, it presents and discusses more recent studies which focus on interactive transfer processes as well as mechanisms of appropriation, and which increasingly combine approaches from imperial history, environmental history, and history of technology.There is much to gain from unpacking the changing motives and ideologies behind technology transfer; tracing the often contested and negotiated flows of ideas, technologies and knowledge within multilayered global networks; investigating the manifold ways in which infrastructures reflected and (re)produced colonial spaces and identities; critically reflecting on the utility of large (socio)technical systems (LTS) for the Global South; and approaching infrastructures in the (post)colonial world through entangled histories of technology and the environment. Following David Arnold’s (2005) plea for a “more interactive, culturally-nuanced, multi-sited debate” on technology in the non-Western world, the paper offers fresh insights for a broader debate about how infrastructures work within specific parameters of time, place and culture. To realize the full potential of solar photovoltaics (PV), PV adopters need to adapt their energy demand to the production of self-generated solar energy as much as possible (i.e., use their PV sustainably). In a longitudinal questionnaire study (N = 74) in the Netherlands, we compared the intention to use PV in a sustainable way before the installation of PV with actual PV use. Wave 1 took place before respondents adopted PV, while Wave 2 took place after they installed PV. (...) We examined whether potential differences between actual sustainable PV use and initial intentions may have implications for how people see themselves and for the motivation they ascribe to their decision to adopt PV. Our results show that the vast majority of people use their PV in a less sustainable way than they anticipated. Furthermore, after the installation of PV, respondents are less likely to see themselves as a sustainable PV user and less likely to believe that PV have positive environmental consequences than before the installation, while environmental self-identity did not differ pre and post-installation of PV. Moreover, the stronger the discrepancy between intended and actual sustainable use of the PV, the less likely people were to see themselves as a sustainable PV user and as a person who acts pro-environmentally in general. These findings suggest that it is important to support people to use their PV in a sustainable way to facilitate them to act upon their intentions. (shrink)

Zusammenfassung Angesichts des fortgesetzten Rückgangs des Organspendeaufkommens in Deutschland werden Forderungen nach Einführung der Widerspruchsregelung bei der Organübertragung post mortem seit längerem nicht mehr nur von der Ärzteschaft, sondern verstärkt auch von politischer Seite erhoben. Gegenstand des Beitrags ist die Prüfung der Vereinbarkeit der gegenwärtig diskutierten Vorschläge zu einer Erhöhung des Organaufkommens mit dem individuellen Selbstbestimmungsrecht, ohne damit eine gesamthafte ethische Nutzen-Kosten-Bilanz dieser Strategien zu präjudizieren. Der Beitrag geht davon aus, dass hauptsächlich drei Faktoren für die Beurteilung relevant (...) sind: 1. ob der Eingriff in die körperliche Integrität zu Lebzeiten oder post mortem erfolgt; 2. die Intensität des Wunsches, nach dem Tod vor solchen Eingriffen geschützt zu sein; 3. das Ausmaß des sozialen Drucks, einen solchen Eingriff zuzulassen. Es ergibt sich, dass eine Widerspruchsregelung unter dem Gesichtspunkt des Selbstbestimmungsrechts einerseits nicht optimal, andererseits aber auch nicht schlechthin inakzeptabel und jedenfalls der Alternative einer Zwangserklärungsregelung vorzuziehen ist. Cross-education is the phenomenon in which repeated practice of a unilateral motor task does not only result in performance improvement of the trained limb, but also in the untrained contralateral limb. The aim of this study was to test whether cross-education or positive transfer of learning is also achieved for tasks in which both limbs contribute in different ways by using modified equipment that switches the limbs’ role. To this end, a reverse field hockey stick was used that requires a (...) mirroring of arm and hand use and dominance. Two groups of young skilled female field hockey players participated in a crossover-design, in which participants received four training sessions with a reverse hockey stick followed by four training sessions with a regular hockey stick, or vice versa. In a pre-test, intermediate test, a post-test and a retention test, participants’ performance on a field hockey skill test with a regular hockey stick was measured. The results revealed that training with the reversed hockey stick led to significantly increased improvements compared to training with a regular hockey stick. We conclude that modified equipment can be used to exploit positive transfer of learning by switching the limbs’ roles. The findings are discussed by referring to the symmetry preservation principle in dynamic systems theory and have clear practical relevance for field hockey trainers and players seeking to further improve field hockey skills. Post-mortem reproduction is a complex and contested matter attracting attention from a diverse group of scholars and resulting in various responses from a range of countries. Vietnam has been reluctant to deal directly with this matter and has, accordingly, permitted post-mortem reproduction implicitly. First, by analysing Vietnam’s post-mortem reproduction cases, this paper reflects on the manner in which Vietnamese authorities have handled each case in the context of the contemporary legal framework, and it reveals (...) the moral questions arising therefrom. The article then offers an account of Vietnamese social norms as an explanation for the tendency to conduct post-mortem reproduction. In arguing that a deeper and more thorough examination of the moral and ethical reasoning is required, the paper advocates in favour of supportive post-mortem reproduction regulation. In doing so, the paper seeks to reconcile the Vietnamese legal framework and post-mortem reproduction experiences of other countries. The article concludes that Vietnam and countries sharing the similar cultural traits should permit post-mortem reproduction explicitly. This would require full engagement with the ethical and legal issues arising, and careful promulgation of regulations and guidelines based on comparative experiences of a range of countries in handling this matter. It has been widely theorized and empirically proven that self-regulated learning is related to more desired learning outcomes, e.g., higher performance in transfer tests. Research has shifted to understanding the role of SRL during learning, such as the strategies and learning activities, learners employ and engage in the different SRL phases, which contribute to learning achievement. From a methodological perspective, measuring SRL using think-aloud data has been shown to be more insightful than self-report surveys as it helps better in determining (...) the link between SRL activities and learning achievements. Educational process mining on the basis of think-aloud data enables a deeper understanding and more fine-grained analyses of SRL processes. Although students’ SRL is highly contextualized, there are consistent findings of the link between SRL activities and learning outcomes pointing to some consistency of the processes that support learning. However, past studies have utilized differing approaches which make generalization of findings between studies investigating the unfolding of SRL processes during learning a challenge. In the present study with 29 university students, we measured SRL via concurrent think-aloud protocols in a pre-post design using a similar approach from a previous study in an online learning environment during a 45-min learning session, where students learned about three topics and wrote an essay. Results revealed significant learning gain and replication of links between SRL activities and transfer performance, similar to past research. Additionally, temporal structures of successful and less successful students indicated meaningful differences associated with both theoretical assumptions and past research findings. In conclusion, extending prior research by exploring SRL patterns in an online learning setting provides insights to the replicability of previous findings from online learning settings and new findings show that it is important not only to focus on the repertoire of SRL strategies but also on how and when they are used. The purpose of this article is not to affirm or deny particular philosophical positions, but to explore the limits of intelligibility about what post-mortem harm means, especially in the light of improper post-mortem procedures at Bristol and Alder Hey hospitals in the late 1990s. The parental claims of post-mortem harm to dead children at Alder Hey Hospital are reviewed from five different philosophical perspectives, eventually settling on a crucial difference of perspective about how we (...) understand harm to the dead. On the one hand there is the broadly 'analytical' tradition1 of thinking that predicates the notion of harm on the basis of an existing subject. Since the dead are non-existent persons, it makes little sense to view the dead as being harmed. On the other hand, there is a phenomenological perspective, where the dead, in respect to the experience of grief, are existentially absent. This forms the basis that it is possible to harm grieving parent's experiences of how their dead are treated. The article ends with a short examination of what harming the dead implies for traditional bioethical concerns, namely, obtaining informed consent from significant others when planning medical research on the newly dead. BackgroundOrgan transplantation represents the most effective and acceptable therapy for end-stage organ failure. However, its frequent practice often leads to a shortage of organs worldwide. To solve this dilemma, some countries, such as Portugal, have switched from an opt-in to an opt-out system, which has raised concerns about respect for individual autonomy. We aimed to evaluate whether young university students are aware of this opt-out system so that they can make informed, autonomous and conscious decisions, as well as to identify (...) the factors that determine a positive attitude toward post-mortem organ donation.MethodsAn observational, cross-sectional study was developed and a questionnaire was administered to first-year students from six faculties of the University of Porto.ResultsOf the 841 participants, 60% were unaware that Portugal had adopted an opt-out system. Among the informed individuals, their main sources of information included social media, internet, and family. Furthermore, only 48% of all participants agreed with the current opt-out system. Female sex (p = 0.049; OR 1.393), knowledge of the law (p < 0.001; OR 4.749) and family being the primary source of information (p < 0.001; OR 2.855) were independent factors associated with a positive attitude toward post-mortem organ donation law.ConclusionsThere is a significant lack of knowledge among young university students regarding the presumed post-mortem organ donation law and how it works. Female sex, having family as a primary source of information and being aware of the presumed post-mortem organ donation law are the strongest independent factors that determine a positive attitude toward the opt-out system.
